Authorize the Town Manager to execute Amendment No. 1 to contract CON-20-127-ENG with Markham Contracting Co., Inc., in the amount not to exceed $50,000 and to waive the 14-day wait period to sign the agreement.
Background
SUMMARY STATEMENT:
On June 25, 2020, Town Council awarded construction contract to Markham Contracting for Lincoln Dr Median Improvements. As part of this contract, the contractor was to identify any areas of fiber conduit repair, if any, and to provide the Town with an estimated cost to repair.
In August 2020, the contractor began median improvements east of Tatum Blvd and in October 2020 informed the Town an estimated cost to repair the fiber conduit was unknown and would be tracked on a time and materials basis. The Town declined the offer and sought a second quote from another subcontractor who could guarantee the work not to exceed $50,000.
In November, the subcontractor performed inspection of the Town's fiber conduit on Lincoln Dr from 32nd St to Mockingbird Ln, and found only one repair needed east of Tatum Blvd at approximately 51st St. While the length of the conduit repair is approximately 60 ft long, there is extensive work required to reroute conduit outside of existing concrete encasement as well as median restoration.
Contracts originally awarded by the Town Council may be amended only with the approval of the Town Council per Town Code Section 2.3.14.6 Contract Amendments. The original construction contract in the amount of $2,333,226.88 will be increased by $50,000 for a total contract amount of $2,383,226.88.
