Background
SUMMARY STATEMENT:
The Mayor and Town Council prioritized trash and recyclable collection as one of the Quality of Life initiatives identified at the beginning of the 2015-2016 Council term. Among the goals the Council wanted to address was improving environmental sustainability. In October 2016, the Council adopted Ordinance Number 2016-12 which included a provision that all vehicles with diesel engines be no older than seven years in order to meet stricter emission standards.
During the discussion prior to adoption, one of the licensed providers requested that the Town consider granting waivers for older diesel engines so long as they were fueled with biodiesel. The Council adopted the ordinance as presented but directed staff to research emissions standards and biodiesel fuel and report back to Council with recommended amendments prior to the July 1, 2017 effective date.
Staff prepared information on diesel and biodiesel emission standards at the Council Study Session on May 11, 2017 The Mayor and Council decided instead to direct staff to issue a Request for Proposal for a single trash and recyclable collection provider. It was agreed that if a license agreement was granted by the Town, it would be more appropriate to incorporate vehicle requirements and emission standards into the agreement rather than adopting Code provisions. However, if the Town Council chooses to reject all proposals and maintain the status quo the Town could revisit Code amendments regulating diesel engine emissions in the future.
Recommendation
It is recommended that the Mayor and Council repeal Town Code Section 8-3-6(A)(5) before it becomes enforceable on July 1, 2017 and proceed with the RFP process.

(5) Starting on July 1, 2017, all vehicles with diesel engines shall be no older than seven (7) years.
A second option is to alter section 8-3-6(A)(5) to require engines no older than 2007. This reflects the commitments current trash haulers licensed in PV made in preparation to this ordinance taking effect July 1, 2017.
