Approve the amendment to Resolution 1247 enabling the construction of entry monuments on Town abandoned property.

Background

 

SUMMARY STATEMENT:

 

The Town of Paradise Valley owned a parcel of land in fee that was associated with a road and utility right-of-way at 66th Place and Stallion in the Town limits.  The property is bordered on three sides by different parcels and corresponding property owners. 

 

In February of 2012, the Town abandoned this roadway tract to John and Elizabeth Lennon in exchange for expected improvements and maintenance of the parcel for roadway purposes.  The Lennon’s have since made these improvements and maintained an access to one adjacent property owner.  The third adjoining property owner declined any access from this tract.  As part of the abandonment, the Town placed several restrictions on the property.  These included: no lot splits nor combination with any other parcel.  Further it prohibited any structure to be built upon it.  The intent of that latter restriction was most notably to prevent making the lot into a non-conforming residential parcel.  However, “structure” is a defined term in the Town’s zoning code to mean: “Anything constructed or erected, the use of which requires a fixed location on the ground.” 

 

The Town has further clarified this in its Building Code to mean anything over eight (8) inches.


The Lennon’s proposed to construct two six foot entry monuments (a.k.a. pilasters, columns, or pillars).  There is no fence or wall attached to these entry monuments and they are intended to define this roadway as a driveway rather than a public road.  The Lennon’s have secured the written approval of the two adjoining parcel owners to this improvement.

 

This action amends Resolution 1247 to allow this type of structure to be placed on the abandoned property.
