RECOMMENDATION:
Recommendation
Forward the Mountain Shadows liquor license application for Acquisition of Control to the Arizona Department of Liquor Licenses and Control with a recommendation for approval.
Background

SUMMARY STATEMENT:
Westroc Hotels & Resorts, LLC which manages Mountain Shadows Resort located at 5445 E Lincoln Drive was recently acquired by The Benchmark Management Company LLC. The resort will remain locally owned but be managed under the brand, Benchmark Resorts & Hotels. As a consequence of the change in ownership, the license will be transferred from Peter Schelstraete, agent for Westroc Hotels & Resort to Andrew Chippindall, agent for The Benchmark Management Company.

Although liquor license applications are filed with the State, which has the primary responsibility for reviewing the application and conducting background checks on the owners and agents, A.R.S. ?4-201 requires that the Town Council hold a public hearing to receive comment on whether or not the issuance of the liquor license is in the best interest of the community. Notice of the application was posted on the applicant's premises for 20 days in accordance with state law. The Town did not receive any arguments in support of or opposition to this application. There are no violations on file with the Arizona Department of Liquor Licenses and Control against Doubletree Resort.

The Paradise Valley Police Department has reviewed the application and finds no reason to oppose it. Additionally, the Community Development Department has no objections to the application insofar as issuance of a liquor license is consistent with the Special Use Permit for this ...
