Approve the Paradise Valley forms of the Video Services License Agreement, Application Form and Affidavit

Background

 

BACKGROUND:

In 2018, the Legislature enacted Senate Bill 1140 (the uniform video service license legislation) that requires cities and towns to adopt a standard uniform video service license agreement and application for the uniform license by July 1, 2019.  By state statute, cities and towns are also required to issue uniform video service licenses to video service providers.  From January 1, 2020 until June 30, 2020, incumbent cable operators may elect to continue to operate pursuant to their existing local license or terminate the local license and apply for a uniform video service license. 

 

At its Study Session on May 23, 2019, the Council reviewed and provided comments to the draft uniform video services license agreement, application and affidavit that was modelled after a draft from the Telecommunications Workgroup (“Telecom Group”)  and Arizona League of Cities and Towns (“League”).

 

The draft uniform video services license agreement contains sixteen separate provisions including the date on which the provider expects to provide video services in the area, a description of the service area to be served, a requirement that the provider will pay the license fees and all other lawful charges imposed by cities and towns, and requirement that the provider comply with federal, state and local laws, consumer privacy mandates and public, education and government programming requirements.  The city or town must issue the uniform license to the applicant thirty days after the filing of a completed application and affidavit.

 

It is recommended that the Council approve the uniform video services license agreement, application and affidavit for Paradise Valley (such forms attached hereto) that are based on the model draft forms from the Telecom Group and the League.

 

Next Steps

Approve the Uniform Video Services License Agreement, and the Application Form and Affidavit, in the forms attached to the Action Report.
