Title
Intergovernmental Agreement (IGA) Amendment No.1 between the Town of Paradise Valley and the State of Arizona for administration of the Lincoln Drive Sidewalk Project
Body
RECOMMENDATION:
Recommendation
Authorize the mayor to execute Amendment No.1 of the IGA between the Town of Paradise Valley and the State of Arizona for administration of the Lincoln Drive Sidewalk Project.
Background
SUMMARY STATEMENT:
In 2016 the Town adopted the attached Resolution 2016-23, authorizing the execution of an IGA between the Town and the State of Arizona for administration of the Lincoln Drive Sidewalk project. This project will fill the sidewalk gaps along Lincoln Drive from 32nd Street to Mockingbird Lane. The project includes approximately two miles of sidewalk, some retaining walls, drainage structure extensions, pedestrian signage, and landscaping. In October of 2018, the State notified the Town that additional money would be required for the construction due to rising labor and material costs. In November, the Town sought additional Congestion Mitigation and Air Quality (CMAQ) funding from the Maricopa Association of Governments (MAG) who administers the CMAQ funding. On January 30, 2019, MAG approved the Town’s request for additional funding for the construction and administration costs resulting in an IGA amendment required by the State in order to revise the original project cost estimate of $2,107,388 to $2,435,000, a total increase of $327,612 of which the Town is responsible for 5.7% ($18,674).
Because the Town is not a qualified agency to self-administer federal funds, an IGA with the State of Arizona is required to receive the CMAQ funds. The State will oversee design, bidding, and construction of this project to ensure the project is adhering to all federal requirements.
BUDGETARY IMPACT:
The Town funds for construction were originally estimated at $118,411.00 in 2016 and have been revised to $137,085.00. The Town will be required to pay the State $137,085.00 prior to bid advertisement anticipated in Spring 2019 and will be required to pay for any amount above the federal aid funds capped at $2,263,200.00.
