RECOMMENDATION:

Recommendation

Adopt Resolution Number 2018-27.

Background

At its Work Study Sessions on September 27, 2018, and October 25, 2018, the Council reviewed draft changes to the Town Zoning Ordinance (at Section 1102.8) that would modify the processes related to the approval or denial of Managerial Amendments to Special Use Permits (hereinafter “Managerial Amendments”).   The Council has now reviewed the draft changes to Section 1102.8 and requested that the Town staff prepare a draft ordinance to be submitted to the Planning Commission for review and recommendations.

Approval of Resolution No. 2018-27 would refer the draft changes of the Zoning Ordinance Amendment regarding Special Use Permit Managerial Amendment process to §1102.8.A of the Town Zoning Ordinance to the Planning Commission for review and action. A copy of the draft ordinance that contains the changes to Section 1102.8 is attached to Resolution No. 2018-27 as Exhibit A.  Additionally, Resolution No. 2018-27 requires the Planning Commission to make a recommendation to the Council regarding the proposed changes to Section 1102.8 by February 6, 2019, which should allow sufficient time for the Commission to have a study session, citizen review meeting, and public hearing on the proposed changes.

SUMMARY STATEMENT:

It is respectfully recommended that the Council adopt Resolution No. 2018-27.

BUDGETARY IMPACT:

None.
