Construction Noise Ordinance

For some time the Town Manager has been asked to waive the time and day restrictions for some construction work that needs to occur on weekends. However, the current Town Ordinances are not clear with respect to the Town Manager’s authority to do such. The attached draft ordinance would amend subsection 10-7-7(A) of the Town Code by giving the Town Manager the discretion, under unusual circumstances, to waive time and day restrictions relating to construction noise generated by construction projects within the Town.
During ongoing construction and development within the Town, there may be occasion for contractors to complete a project by working weekends or extra hours. Discretion to waive time/day restrictions, in exceptional circumstances, will allow the projects to be completed in a timely manner.
If it appears that this draft ordinance is acceptable to the Town Council, this ordinance may be placed on a future Council action agenda for adoption.
SUMMARY STATEMENT:
Staff recommends Council discuss the draft construction noise ordinance at its October 8, 2015 Council meeting and provide direction on any changes needed to the draft ordinance and whether it is ready for approval at a future Council meeting.
