Title
Discussion of a Major General Plan Amendment on a 4.4-acre property located at the northwest corner of the Northern Avenue alignment and Scottsdale Road GP-16-01 (Parcel No. 174-36-002X)
Body

BACKGROUND
Applicant is requesting the Town Council receive the staff presentation, open the public hearing and continue it until a date uncertain. This study session will review why that is being requested and how and why the parliamentary procedure is required.

State Statute
Pursuant to State Statute, a major amendment application to a General Plan must be presented at a public hearing to the Town Council within the same calendar year it was filed. The subject application was duly filed in May 2016.

Planning Commission Action/Discussion
In a vote of 4 to 0 on December 6, 2016 (Commissioners Wastchak, Wincel, and Campbell absent), the Planning Commission recommended forwarding to the Town Council denial of GP-16-01 to change the land use designation from "Low Density Residential" to "Medium Density Residential." This recommendation was made to allow for the applicant to consider other alternatives, allow this matter to be presented at a public hearing to the Town Council within the calendar year of 2016, and provide an opportunity for the Planning Commission to discuss and make a recommendation on this application should the Town Council continue the request.
At the request of the applicant, in a vote of 7 to 0 on November 15, 2016, the Planning Commission continued all six application requests to the meeting of December 6, 2016. This continuance was to provide the applicant to work out a time extension with the seller of the subject site. This has been done.
