Variance to allow an addition to the main residence to encroach into the rear yard setback

Body

Brandon McMahon presented a variance to allow an addition to the main residence to encroach into the rear yard setback at 6124 N Camelback Manor Drive. He provided the parcels historical information, the scope of request specific to the existing front, side, and rear yard setbacks as well as the additional setback to the rear yard. Brandon also provided analysis on the size, shape, and hardships that created a restrictive building envelope. He shared public feedback received and the onsite meeting held by the applicant with surrounding neighbors. Brandon finished his presentation with the Town’s recommendations and possible actions.

 

Board members asked questions to gain clarity on the front, side, and rear yard definitions of which Brandon advised that the yard clarifications have been specified. Board members also inquired as to who gave instructions to install a screen wall of which Brandon advised that the screen wall was volunteered by the applicant.

 

A member of the public outside the neighborhood expressed concerns with the increased encroachment to the mountain views and questioned the parcel’s hardships. Brandon then shared details of a 2002 case variance and the reduction in mandated criteria. He also reiterated the reasons for the approval specific to the variance being in character with the neighborhood as other properties in area having existing setback encroachments.

 

RECOMMENDATION:

Recommendation

Approval of Case No. BA 26 04, a request for a variance from Article X, Height and Area Regulations, to allow an addition to the main residence to encroach into the rear setback.
