Background

 

SUMMARY STATEMENT:

In 2014 Mr Brandon Dale erected a fence along the eastern side of a 404 wash through his property.  He also erected corral fencing at the southwest corner of his property.  Even though this lot is designated as Hillside, no application to the Hillside Building Committee was made.  No building permit was applied for either.  Because of the proximity of the corral to the property line, it would not have been approved.

 

In 2015 he relocated and expanded the corral to the northwest corner of his lot, added a bridge across the wash, constructed a mare motel and a shed at the southwest corner of the lot.  Again all this work was done without Hillside Building Committee or building permit approval.  The shed does not meet the minimum setbacks required.

 

Since fences (and corrals) are not allowed on Hillside lots, Mr Dale decided that the removal from Hillside designation is the preferable option as the lot is relatively flat.  This will allow him to keep the corral and fencing and to relocate the shed to meet the setbacks.  He will have to make an application to the Corps of Engineers to have them review the bridge across the “404” wash.
