Adopt Ordinance 2018-05, the Unruly Gatherings Ordinance and set a 30-day implementation of the ordinance.
Background
SUMMARY STATEMENT:
Paradise Valley Police respond to loud parties at residences in Paradise Valley. Participants are occasionally cited for a noise ordinance violation. Some of the other issues related to parties, including parking on the street and disruption of the neighborhood quality of life cannot be stopped by enforcing only the noise ordinance and additional tools might be needed.
An Unruly Gathering ordinance would provide the police department another tool to address the house parties, through its three-pronged approach. This proposed ordinance would pursue criminal penalties, civil fines and administrative fees against unruly gathering participants and owners of problem properties. The criminal fines associated with the gatherings would increase substantially each time officers are dispatched to police problem properties. Additionally, the ordinance provides provisions to allow owners of rental properties to be cited for unruly gatherings after giving the owner notice that an unruly gathering has occurred on the property.
BUDGETARY IMPACT:
1. Enforcement activity is budgeted within the FY 18 Police Department budget.
2. Any costs associated with the enforcement of second or subsequent Unruly Gatherings will be billed to the participants through administrative fees.
