Recommendation
Adopt Resolution No. 2018-24; authorizing the Town to acquire property interests needed for the Lincoln Drive Sidewalk Expansion Project.
Background
SUMMARY STATEMENT:
Town staff has been working for several months with the Arizona Department of Transportation and a right-of-way acquisition agent (“Agent”) to obtain easements for the Lincoln Drive Sidewalk Expansion Project (“Project”). All of the property owners along Lincoln Drive where the Town needs to acquire sidewalk easements or temporary construction easements have been contacted and advised of the property interests that the Town needs to acquire and advised of the appraised value of the interests the Town’s needs. Negotiations with the property owners has now commenced, however, adoption of Resolution No. 2018-24 is needed in order to allow the Town to finalize contracts with the property owners and then close escrow for each property interest acquisition. In the event that a consensual purchase with any of the property owners cannot be achieved, Resolution No. 2018-24 authorizes the use of eminent domain should such become necessary. The properties that the Town will purchase sidewalk and temporary construction easements on include the following: County Assessor parcel numbers 164-64-015, 169-19-006D, 169-46-036, 174-62-001D, 174-62-001 E, 174-62-007, 174-62-013K, 174-62-013G and 174-62-013E.
Acquisition of the land interests identified will allow for continuous sidewalk improvements on both the north and south side of Lincoln Drive beginning at the western town limits at 32nd Street east to Mockingbird Lane. The largest stretch of sidewalk improvements will occur on the north side of Lincoln Drive on the western side of the Town.
BUDGETARY IMPACT:
The Town has budgeted $350,000 in the FY2018/19 Capital Improvement Plan for easement acquisition related to the Lincoln Drive Sidewalk Project. The total appraised value of all of the required easements is less than the budgeted amount.
