Removing the Hillside designation will allow the property to be developed consistent with other properties in this area directly adjacent to McDonald Drive.

RECOMMENDATION:

Approval of Resolution 2018-10 to remove the hillside designation on the property located at 5445 E. McDonald Drive (APN: 169-50-003), including its reference on Figure 2, Hillside Development Area, of Article XXII, Hillside Development the Town Zoning Ordinance.

 

SUMMARY STATEMENT:

The applicant represents the property owner of 4554 E. McDonald Drive (APN: 169-50-003), located two lots east of the northeast corner of 45th Street and McDonald Drive. The Town has removed hillside designations in the past if the average lot slope is less than ten percent. The subject lot borders McDonald Drive which is a major arterial roadway and it has an average lot slope of approximately 2.9 percent and a building pad slope of approximately 1.5 percent.

 

By removing the Hillside designation the property would be required to conform to non-hillside building regulations which allows for free standing site walls but reduces the overall maximum allowable height of the residence.

 

Hillside Development Regulations:

The Hillside Development Regulations define the Hillside Development Area as the following:

 

Those areas marked in FIGURE 2 and to all lands where the natural terrain under the building pad has a slope of ten percent (10%) or greater, whether shown in FIGURE 2 or not.  However, a 10% or greater slope, in an area not denoted on Figure 2, created by a natural wash on land that otherwise would not be classified as hillside land shall be exempt from the hillside regulations.   

 

It should be noted that the Hillside Development Regulations do not currently describe the process of which to remove a property from the Hillside Development Area. Past practice typically included review by the Hillside Building Committee and approval by Town Council. Average building pad slope and lot slope were commonly reviewed to determine the merit to remove a property from the Hillside Development Area. Average lot slope is used for new plats to determine minimum lot size per Section 2209, Density and Subdivisions /Lot Split Standards, of the Hillside Development Regulations.

 

Hillside Building Committee Recommendation:

Neighbors in the vicinity of the property spoke in favor a removing the hillside designation and the Hillside Building Committee voted unanimously (4-0) at their March 14, 2018 meeting to forward a recommendation of approval to Town Council to remove the hillside designation on the property located at 4554 E. McDonald Drive.
