Background
SUMMARY STATEMENT:
The owners of Lot 9, Camelhead Estates Unit 2, Michael and Alicia Markham, have requested that the Town abandon a portion of an existing 40’ drainage easement on their property, SEE EXHIBIT “A” for the exact location. The drainage easement was created when the property was subdivided in 1976. The main wash is actually located on the west side of the property. Prior to the Markham’s purchasing the property they had inquired about the possibility of abandoning this portion of the drainage easement on the property. The Markham’s and their realtor discovered that the two (2) properties to the north of Lot 9 (Lots 7 & 8) had previously obtained approval from the Town to abandoned the drainage easement. These approvals had occurred in 1982 for Lot 7 Camelhead Estates Unit 2(Resolution #397) and 1993 for Lot 8 Camelhead Estates Unit 2 (Resolution 760).
The Markham’s hired a Civil Engineer, Aubry Thomas P.E. of Hilgart Wilson Engineers, to perform a drainage study and analysis to determine the drainage patterns and to verify that the abandonment of the drainage easement would have no effect on any other properties. The Engineering Department reviewed the report and the accompanying documentation and find that the abandonment of said easement will have no effect on the drainage patterns in this area.
With approval of Resolution 2016-21 the Town will abandon a portion of the existing 40-foot drainage easement. Staff recommends abandonment of a portion of the easement as indicated in Exhibit A, with the drainage easement to remain in place shown in Exhibit B.
