Background

BACKGROUND:
The Town of Paradise Valley is sponsoring a free community drowning prevention and awareness event called the Camelback Mountain Solar Plunge on Saturday March 28, 2020. Drowning is one of the leading causes of unintentional deaths in children ages 5 and under. The Town of Paradise Valley has partnered with the Drowning Prevention Coalition of Arizona, the YMCA, Paradise Valley Public Safety Foundation, Phoenix Swim Club, Arizona Cardinals, El Chorro Lodge, Wrigley Mansion Group, Special Olympics and JW Marriott all in an effort to help the community at large learn more about water safety. Participants are encouraged to dress in fun attire and take a plunge into warm water for a chance to win fun prizes and awards.

PCDS, through the Phoenix Swim Club, has agreed to allow the Town to use their campus and pool for the Solar Plunge event, but PSC first requires that the Town execute a Facilities Use Agreement with the PSC. The Facilities Use Agreement only requires the Town to pay for the lifeguard services ($400), and is mainly required by PSC to insure that the event sponsor (the Town) has adequate insurance and will indemnify the PSC for any claims made against PSC or PCDS "arising from the acts, errors, mistakes, omissions, or use of facility by the Town, its agent, employees, invitees, [or] guests."
