Background

BACKGROUND:

This matter arose from the Town’s need to acquire a 10-foot-wide easement along the north boundary line of the parcel located at 6723 E. Lincoln Drive (the “Property”) owned by the Abdul A. Mahmood and Erum Noon (“Owners”) for construction of a segment of the Lincoln Drive sidewalk project.  During a settlement conference on July 15, 2019, the Town’s representatives and the Owners reached a conditional settlement agreement (“conditional” in that the settlement must still be approved by the Council).  If approved the settlement will resolve all claims and permanently vest title to the sidewalk easement area to the Town.  The amount of the settlement will be discussed in an executive session with the Council earlier in the meeting on September 12, 2019 meeting, thus listing the details of the settlement are premature until the Council first hears of the settlement terms.

 

RECOMMENDATION: It is recommended the Council approve the Conditional Settlement and authorize the Town Manager and Town’s attorneys to execute a stipulated judgment settling case #CV 2018-015014 with Abdul Mahmood and Erum Noon; the amount of the judgment to be $                                                                                    .
